Please read these Terms carefully. By applying to, participating in, or using an affiliate link for the Carni-Con Affiliate Program, you agree to be bound by them.

These Affiliate Program Terms & Conditions (the “Terms”) govern participation in the Carni-Con Affiliate Program (the “Program”) operated by For Real Events and/or its Carni-Con brand (“Carni-Con,” “we,” “us,” or “our”). “Affiliate,” “you,” and “your” mean the individual or entity accepted into the Program.

These Terms supplement any campaign details, commission schedule, written offer, or instructions displayed in the affiliate portal. If a specific written campaign term conflicts with these Terms, the campaign term controls only for that campaign and only to the extent of the conflict.

1. Eligibility and Enrollment

1.1 Application. Participation is by approval only. We may accept or reject an application in our sole discretion, with or without explanation.

1.2 Accurate Information. You must provide complete and accurate contact, payment, tax, and promotional-channel information and keep it current.

1.3 Minimum Requirements. You must be at least 18 years old and legally able to enter into a binding agreement. If you participate for a company or organization, you represent that you have authority to bind it.

1.4 No Guaranteed Acceptance or Earnings. Acceptance into the Program does not guarantee any level of traffic, sales, commissions, continued participation, or future campaign access.

2. Affiliate Relationship

2.1 Independent Contractor. You participate as an independent contractor. Nothing in these Terms creates an employment, agency, partnership, franchise, joint venture, fiduciary, or representative relationship.

2.2 No Authority to Bind. You may not make commitments, promises, warranties, refunds, pricing changes, or representations on behalf of Carni-Con, nor suggest that you are an employee or authorized spokesperson unless we have expressly authorized that role in writing.

2.3 Your Costs and Taxes. You are responsible for your own costs, equipment, business expenses, licenses, insurance, and taxes arising from your Program participation or commission income.

3. Affiliate Links, Tracking, and Attribution

3.1 Unique Tracking Tools. We may provide unique referral links, coupon codes, campaign links, QR codes, or other tracking tools (“Affiliate Links”). You may use only the tracking tools assigned or approved for you.

3.2 Attribution. A sale is commissionable only if it is properly tracked and attributed to your Affiliate Link or approved code in our affiliate platform. Unless a campaign states otherwise, attribution is based on the platform’s recorded last eligible referral before purchase.

3.3 Tracking Limitations. Tracking may be affected by cookie settings, privacy tools, device changes, browser restrictions, deleted cookies, customer actions, incorrect links, or third-party platform limitations. We are not responsible for commissions that cannot be reliably tracked or verified.

3.4 No Manual Credit Guarantee. We may review a missing-sale request, but we are not required to manually assign credit. Our affiliate platform records and internal transaction records control absent clear evidence of error.

3.5 Link Integrity. You may not alter, obscure, redirect, frame, shorten deceptively, or manipulate Affiliate Links in a way that interferes with tracking, misleads a visitor, or hides the destination.

4. Commissions and Qualified Transactions

4.1 Commission Rate. Your commission rate and eligible products are stated in Schedule A, the affiliate portal, or a separate written campaign offer. Rates may differ by product, ticket type, promotion, affiliate, or campaign.

4.2 Qualified Transaction. A “Qualified Transaction” is a completed, legitimate purchase that:

is attributable to your approved Affiliate Link or code;

is paid in full using a valid payment method;

is not canceled, refunded, disputed, fraudulent, duplicated, or charged back;

does not violate these Terms or any campaign restriction; and

is accepted as commissionable in our affiliate platform and records.

4.3 Excluded Amounts. Unless expressly stated otherwise, commissions are calculated on net revenue actually received by Carni-Con, excluding taxes, processing fees, shipping, refunds, credits, discounts funded by us, chargebacks, and other excluded amounts.

4.4 Self-Referrals. Self-referrals are permitted. Purchases made through your own link by you, your household, controlled entities, or payment methods under your control may be denied if they are intended primarily to generate commission.

4.5 Existing Customers and Prior Referrals. We may exclude transactions that were already in our pipeline, previously attributed to another affiliate, made through an unapproved code, or otherwise outside the stated campaign rules.

5. Payment Terms

5.1 Payment Schedule. Approved commissions will be paid according to Schedule A or the affiliate portal, subject to the applicable validation and refund-hold period.

5.2 Payment Threshold. No Minimum.  

5.3 Payment Method. You must maintain a valid payment method and provide any required tax documentation. We may delay payment until required information is complete and verified.

5.4 Refunds, Disputes, and Chargebacks. Commissions associated with refunded, disputed, fraudulent, canceled, or charged-back transactions are not payable. If already paid, we may deduct the amount from future commissions or request repayment.

5.5 Good-Faith Adjustments. We may correct calculation, tracking, duplication, or payment errors. Our good-faith determination of commission eligibility is final, subject to applicable law.

5.6 Unclaimed Funds. If we cannot pay you because your information is missing or invalid, we may hold the funds for the period required by law. Any unclaimed funds will be handled under applicable unclaimed-property rules.

6. Required Disclosures and Truthful Promotion

6.1 Clear Affiliate Disclosure. Every promotional communication must clearly and conspicuously disclose your financial relationship with Carni-Con in a way an ordinary viewer can notice and understand before or near the Affiliate Link. Examples include “I may earn a commission if you purchase through this link” or “Affiliate link.”

6.2 Platform Rules and Law. You must comply with all applicable advertising, endorsement, email, privacy, consumer-protection, and anti-spam laws, as well as the rules of each platform you use.

6.3 Honest Claims. Your statements must be truthful, supportable, and based on your genuine experience or reliable information. You may not make false, misleading, unsubstantiated, or exaggerated claims about Carni-Con, its speakers, attendees, products, ticket availability, outcomes, pricing, value, or guarantees.

6.4 Health and Medical Claims. Carni-Con is an educational and community event, not medical care. You may not state or imply that attending Carni-Con, following a carnivore or animal-based diet, purchasing any related product, or listening to any presenter will diagnose, treat, cure, prevent, or guarantee improvement of any disease or medical condition. Do not give personalized medical advice on our behalf.

6.5 Testimonials. Testimonials must reflect genuine experiences and may not be fabricated, materially edited, or presented as typical when they are not. Any material limitations or atypical results must be disclosed where required.

7. Approved and Prohibited Promotional Practices

7.1 Approved Channels. You may promote through your own websites, email lists, podcasts, social media, videos, communities, and direct communications, provided you have the right to use the channel and comply with these Terms.

7.2 Prohibited Conduct. You may not:

send unsolicited commercial email, bulk messages, automated direct messages, or spam;

use misleading subject lines, fake urgency, false scarcity, deceptive countdowns, or claims of guaranteed access;

bid on, purchase, or use “Carni-Con,” confusingly similar terms, presenter names, or our trademarks as paid-search keywords without written permission;

create websites, social accounts, domains, groups, pages, or ads that impersonate Carni-Con or appear to be official;

use cookie stuffing, forced clicks, adware, spyware, browser extensions, pop-ups, hidden iframes, click injection, bot traffic, or other artificial attribution methods;

post Affiliate Links on coupon, cashback, rebate, deal, or discount-code sites without written permission;

offer unauthorized discounts, rebates, bonuses, giveaways, sweepstakes, or incentives tied to a purchase;

misrepresent ticket prices, deadlines, speaker commitments, agenda details, access levels, refund rights, or event features;

place promotions alongside unlawful, hateful, harassing, defamatory, sexually explicit, violent, discriminatory, or deceptive content;

infringe copyrights, trademarks, publicity rights, privacy rights, or other rights of Carni-Con, presenters, sponsors, attendees, or third parties; or

engage in conduct that could reasonably damage Carni-Con’s reputation, community trust, deliverability, payment processing, or relationships.

7.3 Incentives and Bonuses. Any bonus you offer must be lawful, accurately described, fulfilled entirely by you, and clearly distinguished from benefits provided by Carni-Con. You are solely responsible for your bonus, support, delivery, taxes, refunds, and claims.

8. Brand Assets and Intellectual Property

8.1 Limited License. While you remain in good standing, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use approved Carni-Con names, logos, graphics, and promotional materials solely to promote authorized campaigns.

8.2 Brand Standards. You must use current, approved assets without altering proportions, colors, wording, trademarks, speaker images, seals, or required notices, except for resizing that preserves appearance. We may require correction or removal at any time.

8.3 Ownership. Carni-Con and its licensors retain all rights in their brands, event names, content, recordings, graphics, websites, speaker materials, and other intellectual property. No ownership transfers to you.

8.4 No Registration. You may not register or claim rights in any domain, social handle, business name, trademark, advertising account, or other identifier containing Carni-Con or a confusingly similar term.

8.5 Presenter Rights. Permission to promote Carni-Con does not grant permission to use a presenter’s name, likeness, credentials, quotes, photos, recordings, slides, or trademarks beyond assets expressly supplied or approved for the campaign.

9. Customer Information and Privacy

9.1 No Ownership of Customer Data. Customers referred through the Program are Carni-Con customers. You have no right to access, export, retain, sell, or use customer information unless we expressly provide it and authorize a specific use.

9.2 Your Data Practices. If you collect personal information through your own website, forms, email list, pixels, cookies, or promotions, you are independently responsible for lawful notices, consent, security, storage, and use.

9.3 Confidential Information. Non-public information about commissions, conversion data, launch plans, speaker arrangements, customers, pricing, systems, or business operations must be kept confidential and used only for Program participation.

10. Monitoring and Records

10.1 Compliance Review. We may monitor promotional activity and request copies, screenshots, traffic sources, campaign data, disclosure language, or other reasonable evidence of compliance.

10.2 Cooperation. You must promptly correct or remove noncompliant content and cooperate with reasonable investigations of suspected fraud, complaints, trademark misuse, or legal violations.

10.3 Records. You should retain sufficient records to substantiate your disclosures, claims, permissions, and promotional practices for at least two years. 

11. Suspension and Termination

11.1 Termination by Either Party. Either party may end participation at any time by written notice. We may also suspend links, withhold access, or terminate immediately if we reasonably believe there is fraud, legal risk, brand harm, a material breach, or conduct requiring investigation.

11.2 Effect of Termination. Upon termination, you must stop presenting yourself as a Carni-Con affiliate and discontinue use of Affiliate Links and brand assets. Valid commissions earned before termination may remain payable after the validation period, except commissions connected to a violation, fraud, chargeback, or excluded transaction.

11.3 Survival. Provisions concerning payment adjustments, confidentiality, intellectual property, privacy, indemnification, disclaimers, limitations of liability, dispute resolution, and obligations intended by their nature to survive will remain in effect.

12. Program Changes and Availability

12.1 Changes. We may modify the Program, commission rates, eligible products, tracking rules, assets, payment schedules, or these Terms. Material changes will be communicated through the affiliate portal, email, or publication of revised Terms with a new effective date.

12.2 Continued Participation. Continuing to use Affiliate Links after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop participating.

12.3 No Continuity Guarantee. We may pause, cancel, replace, reschedule, reformat, or discontinue an event, offer, campaign, or the Program. Commission eligibility will be determined from actual completed Qualified Transactions and any campaign-specific terms.

13. Disclaimers

THE PROGRAM, AFFILIATE PORTAL, LINKS, MATERIALS, TRACKING, AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARNI-CON DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ANY WARRANTY OF EARNINGS, CONVERSION, TRAFFIC, OR UNINTERRUPTED TRACKING.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARNI-CON AND ITS OWNERS, AFFILIATES, CONTRACTORS, PRESENTERS, SPONSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES; OR TRACKING OR PLATFORM FAILURES ARISING FROM OR RELATED TO THE PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARNI-CON’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE PROGRAM WILL NOT EXCEED THE TOTAL COMMISSIONS PAID OR PAYABLE TO YOU DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

15. Indemnification

You will defend, indemnify, and hold harmless Carni-Con, For Real Events, their owners, affiliates, contractors, presenters, sponsors, and service providers from claims, losses, liabilities, penalties, costs, and reasonable attorneys’ fees arising from or related to your promotions, content, claims, data practices, incentives, legal violations, breach of these Terms, or infringement of another party’s rights.

16. Governing Law and Disputes

16.1 Governing Law. These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.

16.2 Informal Resolution. Before filing a legal action, the parties will make a good-faith effort to resolve the dispute through written notice describing the issue and requested resolution. The receiving party will have 30 days to respond.

16.3 Venue. Unless applicable law requires otherwise, any legal proceeding arising from these Terms or the Program must be brought in the state or federal courts located in or serving Estill County, Kentucky, and each party consents to personal jurisdiction and venue there.

17. General Terms

17.1 Entire Agreement. These Terms, Schedule A, campaign-specific terms, and any written amendment form the entire agreement concerning the Program and replace prior discussions or understandings on that subject.

17.2 Assignment. You may not assign or transfer your Program rights or obligations without our written consent. We may assign these Terms as part of a reorganization, sale, or transfer of the Program or business.

17.3 Severability. If a provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in effect.

17.4 Waiver. A failure to enforce a provision is not a waiver of that provision or any other right.

17.5 Electronic Communications. You consent to receive Program notices electronically through email, the affiliate portal, or the Program website.

17.6 Notices. Notices to Carni-Con must be sent to [email protected]. Notices to you may be sent to the email associated with your affiliate account.

17.7 Headings. Headings are for convenience and do not affect interpretation.

18. Acceptance

By submitting an affiliate application, clicking an acceptance box, accessing the affiliate portal, using an Affiliate Link, or otherwise participating in the Program, you acknowledge that you have read, understood, and agreed to these Terms and any applicable campaign-specific requirements.

A.1. Campaign-Specific Overrides

A written campaign offer may temporarily change an eligible product, rate, attribution window, payment timing, or promotional requirement. Any override should identify the campaign and its effective dates. All other provisions of these Terms remain in effect.

A.2. Commission Example

Illustration only: If an eligible ticket has a net commissionable amount of $197.00 and the applicable commission rate is 20%, the potential commission is $39.40, subject to tracking, refund, chargeback, tax, exclusion, and validation rules.
